The Certificate in Immigration and Refugee Board of Canada (IRB) Fundamentals course provides an in-depth understanding of the foundational aspects of the IRB, including its structure, practices, and procedures. This course is designed to equip immigration practitioners with the knowledge they need to navigate IRB processes effectively.

Please note: This course does not replace the CICC Specialization Course and does not grant authorization to practice before the IRB.

Topics and Learning Objectives: IRB Fundamentals

Canadian Immigration Policy

• The history and hierarchy of Administrative Tribunals and Courts in Canada.
• Relevant sections of the Immigration and Refugee Protection Act (IRPA), Immigration and Refugee Protection Regulations (IRPR), Administrative Tribunal Rules, and Court Rules.
• Canadian legal terminology applicable to the Immigration and Refugee Board (IRB) and Appeals.

Administrative Law and Advocacy

• Principles of Administrative Law, including procedural fairness, natural justice, and fundamental justice.
• Burden of Proof and Standard of Proof as they apply to IRB cases.

Ethics and Professional Responsibility

• The meaning and implications of the CICC’s Code of Professional Ethics.
• Applications of the Code of Professional Ethics to specific situations.
• The permitted scope of practice and the meaning of professional practice.

IRB and Administrative Tribunals

• The structure of the Immigration Refugee Board (IRB) and its four divisions: Refugee Protection Division, Refugee Appeal Division, Immigration Division, and Immigration Appeals Division.
• The difference between tribunals and courts.
• Detention reviews, Admissibility Hearings, Appeals, and Judicial Reviews.

Admission Requirements

• Canadian Lawyers in good standing with their Provincial or Territorial Law Society or a Notary who is a member in good standing of the Chambre des notaires du Quebec.
• Any other member in good standing of a law society of a province or territory or the Chambre des notaires du Quebec, including a Paralegal.
• Regulated Immigration and Citizenship Consultants licensed by the College of Immigration and Citizenship Consultants.
• Employees, Agents, or Staff of the aforementioned authorized immigration practitioners.
• Members, Staff, and Employees of International Organizations, Embassies, Federal, Provincial, Municipal, Community, and Other Related Organizations that directly deal with foreign nationals on immigration, refugee, and citizenship-related matters.

Credential

Upon completion of the course requirements, a Statement of Completion will be issued.
